2. What is the purpose for processing your personal data and what is the legitimate basis for processing them?

At Be Casa we will use the personal data collected from the forms on this website for the following main purposes:

To send you commercial communications about our services and products, as well as to send you promotions and news that may be of interest to you.

The legal basis that legitimises the processing of your personal data is your express consent (art. 6.1 a) of GDPR). You may withdraw your consent at any time, without affecting the legitimate basis for processing the data based on your consent prior to its withdrawal.

Contact form:

After receiving your request, we will contact you to answer any questions you may have regarding our services.

The legal basis for processing these data is a legitimate interest (art. 6.1 f) of GDPR) in being able to respond to a request made by you, in such a way that, under no circumstances, can your interests be considered to be affected.

Booking of short-term accommodation:

To process your request for accommodation, which will allow you to enjoy your stay at our establishment.

The legal basis for this processing is the performance of a contract under Article 6.1 b) of GDPR, understood as the booking conditions accepted at the time of formalising the reservation for the accommodation. Your data needs to be processed to ensure the correct provision of the contracted service.

Booking of long-term accommodation:

To process your request for accommodation, which will allow you to enjoy your stay at our establishment. For this purpose, a personal and non-transferable user account will be created for you using the e-mail address you have provided so that you can send us the necessary documentation to assess your request.

The legal basis for this processing is the performance of a contract under Article 6.1 b) of GDPR, understood as the booking conditions accepted at the time of formalising the reservation for the accommodation. Your data must be processed to ensure the correct provision of the contracted service.

As soon as we receive this documentation, the data controller will proceed to assess your request to ensure that you will be able to meet the payments of the contracted accommodation. If it is determined that you do not meet the conditions established, your request to book accommodation may be denied or you may be asked to provide some kind of guarantee or security, in which case, depending on the specific circumstances, Be Casa may process the information provided for the sole purpose of guaranteeing payment for the accommodation contracted. The data subject may not object to such processing, given the existence of the compelling legitimate grounds of the data controller.

Organising visits to the accommodation:

Should you express your interest in visiting a property, the data provided will be processed to arrange the visit to the selected accommodation.

The legal basis that legitimises the processing of the data is the application of pre-contractual measures following your request, in accordance with Article 6.1 b) of GDPR, as it is understood that you have an interest in contracting the accommodation services of one of the assets of the data controllers. Your data must be processed for the visit to be carried out correctly.

If you consent, your data may be processed for the purpose of sending commercial communications, including by electronic means, about the asset with which you have contracted accommodation, as well as about our products, services and/or promotions.

The legal basis that legitimises the processing of your personal data is your express consent (art. 6.1 a) of GDPR). You may withdraw your consent at any time, without affecting the legitimate basis for processing the data based on your consent prior to its withdrawal.

If you consent, your data may be disclosed to Greystar Group companies so that they can send you commercial information, including by electronic means, about products or services similar to those contracted with the data controller. 3. What personal data do we process?

To comply with the purposes detailed in the previous section, Be Casa will mainly process identification and contact data such as your name and surname, address, contact telephone number and email address that you have provided to us, as well as any other information related to your reservation request.

Should you make a reservation for long-term accommodation, we will ask you for additional information to enable us to assess your ability to meet the cost of the accommodation you intend to book. To this end, we may ask you to provide certain financial documentation (pay slips, VAT statements, if applicable, a guarantee from a third party, etc.).

4. To whom will your data be disclosed?

We hereby inform you that Be Casa will not disclose your personal data to third parties, except in compliance with legal obligations. However, the data may be disclosed to Greystar Group companies so that they can send you commercial information, including by electronic means, about products or services similar to those contracted with your data controller, provided that you have consented to this. On the other hand, to be able to provide you with our services, we hereby inform you that we require the support of service providers. These third parties may have access to your data and will act on our behalf and on our account, following our instructions, and in no case will they have access to your data for their own purposes. One of our main service providers is Greystar Spain, S.L., as it is responsible for the management of our establishments by virtue of the Project Management contracts signed.

5. How long will we keep your personal data?

Be Casa will keep your personal data for as long as necessary to fulfil the purpose for which it was collected. Should you ultimately contract any of the services offered through this website, your personal information will be processed for as long as it is necessary to provide you with the service and, as soon as you cease to be considered a user of our accommodation, it will be duly blocked for 5 years. Following the expiry of this period, after which no further legal liability can be derived from the service provided, your data will be permanently deleted.

Personal data provided for commercial purposes will be kept for as long as you do not revoke your consent and will subsequently be duly blocked for 10 months in compliance with the obligations set out in Personal Data Protection regulations.

6. What are your rights as the data subject?

You are hereby informed that you have rights in relation to the processing of your personal data, such as the right to access, rectify or delete your personal data, or to limit the processing thereof, to object to such processing, as well as the right to data portability in accordance with the terms set out in the data protection legislation in force. You can exercise your rights by contacting privacy@graystar.com and clearly indicating the right you wish to exercise. The exercise of these rights shall be free of charge except where requests are manifestly unfounded or excessive.

Should you consider that Be Casa has not processed your personal data in accordance with applicable regulations, you may file a complaint with the Spanish Data Protection Agency through the website www.aepd.es.
