2. For what purpose do we process your personal data and what is the legal basis for such processing?

At Be Casa we will use the personal data collected through the forms on this website for the following main purposes:

“Leave your details and we will notify you”:

To send you marketing communications to inform you about our services and products, as well as to send you offers and news that may be of interest to you.

The legal basis that legitimises the processing of your personal data is your explicit consent (Art. 6(1)(a) GDPR). You are informed that you may withdraw your consent at any time, without this affecting the lawfulness of processing based on consent before its withdrawal.

Contact form:
After receiving your request, we will contact you to respond to any questions or enquiries you may have regarding our services.

The legal basis that legitimises this processing is our legitimate interest (Art. 6(1)(f) GDPR) in being able to respond to a request made by you, such that, in no case, may it be considered that your interests will be affected.

Short-stay accommodation booking:
To process your accommodation booking request, enabling you to enjoy your stay.

The legal basis that legitimises this processing is the performance of a contract in accordance with Article 6(1)(b) GDPR, understood as the booking conditions accepted at the time you formalise the booking for the accommodation. The processing of your data is necessary for the proper performance of the contracted service.

Long-stay accommodation booking:
To process your accommodation booking request, enabling you to enjoy your stay. To do so, a personal and non-transferable user account will be created using the email address you have provided so that you can send us the documentation required to assess your request.

The legal basis that legitimises this processing is the performance of a contract in accordance with Article 6(1)(b) GDPR, understood as the booking conditions accepted at the time you formalise the booking for the accommodation. The processing of your data is necessary for the proper performance of the contracted service.

Once we receive this documentation, the data controller will assess your application in order to ensure that you will be able to meet the payment for the contracted accommodation. If it is determined that you do not meet the conditions established by the controller, your accommodation booking request could be denied or, alternatively, you may be asked to provide some form of surety or guarantee, as applicable, depending on the specific case. Be Casa may process this information provided solely for the purpose of guaranteeing payment for the contracted accommodation. The data subject may not object to the data controller carrying out this processing due to the existence of compelling legitimate grounds of the data controller.

Arranging visits to the accommodation:
If you inform us of your interest in visiting a property, the data provided will be processed in order to manage the visit to the selected accommodation.

The legal basis that legitimises this processing is the application of pre-contractual measures following your request in accordance with Article 6(1)(b) GDPR, understood as the booking conditions accepted at the time you formalise the booking for the accommodation. The processing of your data is necessary for the proper management of the visit.

If you consent, your data may be processed for the sending of marketing communications, including by electronic means, about the asset for which you have a contracted accommodation service, as well as about our products, services and/or promotions.

The legal basis that legitimises the processing of your personal data is your explicit consent (Art. 6(1)(a) GDPR). You are informed that you may withdraw your consent at any time, without this affecting the lawfulness of processing based on consent before its withdrawal.

If you consent, your data may be communicated to companies within the Greystar Group so that they may send you marketing information, including by electronic means, about products or services similar to those contracted with your data controller. These companies offer accommodation services of different types. You can consult the entities of the Greystar Group at the following URL: https://www.greystar.com.

The legal basis that legitimises the processing of your personal data is your explicit consent (Art. 6(1)(a) GDPR). If you wish to withdraw your consent for this purpose, you may do so at any time by sending your request to privacy@greystar.com.

3. What personal data do we process?

To fulfil the purposes detailed in the previous section, at Be Casa we will mainly process identification and contact data such as your first and last name, address, contact telephone number and email address that you have provided to us, as well as any other information related to your booking request.

If you make a long-stay accommodation booking, we will request additional information that allows us to assess your solvency to meet payment for the accommodation you intend to book. To this end, we may ask you to provide certain financial documentation (pay slips, VAT returns, where applicable a surety or guarantee from a third party, etc.).

4. To which recipients will your data be communicated?

We inform you that Be Casa will not disclose your personal data to third parties, except in compliance with a legal obligation. However, they may be communicated to companies within the Greystar Group so that they may send you marketing information, including by electronic means, about products or services similar to those contracted with your data controller, provided that you have consented. On the other hand, in order to provide our services to you, we require the support of service providers. These third parties may have access to your data and will act on our behalf and for our account, following our instructions, and in no case will they use your data for their own purposes. One of our main service providers is Greystar Spain, S.L., as it is responsible for managing our establishments under the Project Management contracts entered into.

5. How long will we keep your personal data?

Be Casa will keep your personal data for as long as necessary to fulfil the purpose for which it was collected. In those cases in which any of the services offered through this website are ultimately contracted, your personal information will be processed for as long as necessary to provide you with the service and, as soon as you cease to be considered a user of our accommodation, it will be duly blocked for a period of 5 years. Once that period has elapsed, during which no further legal liabilities may arise from the service provided, your data will be permanently deleted.

With regard to personal data provided for marketing purposes, it will be kept until you withdraw your consent and, subsequently, it will be duly blocked for a period of 10 months in compliance with the obligations set out in personal data protection regulations.

6. What are your rights as a data subject?

We inform you that you have rights in relation to the processing of your personal data, such as the right to access your personal data, and to rectify or erase it, or to restrict its processing, to object to it, as well as the right to data portability, under the terms provided for in the applicable data protection legislation. You may exercise your rights by contacting privacy@greystar.com, clearly indicating the right you wish to exercise. Exercising these rights will be free of charge unless the requests are manifestly unfounded or excessive.

If you consider that Be Casa has not processed your personal data in accordance with the applicable regulations, you may lodge a complaint with the Spanish Data Protection Agency through the website www.aepd.es.
